These Terms and Conditions (“Terms”) govern your use of terminalpursuit.com (the “Site”) and any purchase from Terminal Pursuit Ammo (“Terminal Pursuit,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms, our Shipping & Returns policy (including our Return, Refund & Cancellation terms), and our Ammunition Purchase Requirements. Please also read our Privacy Policy to learn how we handle your personal information.

1. Who May Buy From Us

• You must be legally permitted to purchase and possess the products you order where you live and where the order is delivered.
• You must be buying for your own lawful use, and not on behalf of anyone who is prohibited from purchasing or possessing ammunition.
• You confirm that the information you give us is accurate and complete.
• We may ask for age, identity, or eligibility verification before shipping, and we may cancel any order if we cannot verify eligibility.

2. Shipping Restrictions

• Destination restrictions and eligibility requirements are set out in our Ammunition Purchase Requirements and our Shipping & Returns policy.
• We will not knowingly fill an order that would violate federal, state, or local law.
• You are responsible for knowing and following the laws that apply to your purchase, transport, and possession of our products.

3. Products and Descriptions

• We work to describe and photograph our products accurately.
• Some specifications come from component or product manufacturers, and packaging, colors, and appearance may vary.
• If a product you receive is not as described, contact us and we will handle it under our Shipping & Returns policy.

4. Prices and Taxes

• All prices and payments are in U.S. dollars.
• Prices and availability may change at any time before you place your order.
• Applicable sales taxes and shipping charges are shown at checkout before you submit your order.
• If a product is listed at an incorrect price, we may cancel the affected order and refund your payment in full.

5. Orders and Acceptance

• Placing an order is an offer to buy the products in your cart.
• Your order confirmation email confirms that we received your order. It does not mean we have accepted it.
• We accept your order when it ships.
• We may refuse or cancel any order, limit quantities, or require verification before shipping. If we cancel an order, we will refund the amount paid in full or void an unsettled payment.

6. Payment

• We accept Visa, Mastercard, and American Express.
• Card payments are processed securely through Authorize.net. We do not store full card numbers.
• By placing an order, you confirm you are authorized to use the payment method and you authorize us to charge the order total, including shipping and applicable taxes.
• Charges appear on your card statement as “Terminal Pursuit Ammo.”

7. Shipping and Delivery

• Ammunition ships by UPS Ground or FedEx Ground only. We do not ship ammunition by air, by expedited service, or through the U.S. Postal Service.
• Processing times, delivery estimates, adult-signature requirements, and how we handle incorrect addresses, refused deliveries, and undeliverable packages are covered in our Shipping & Returns policy.
• We are responsible for your order until it is delivered to the address you provide.
• You are responsible for giving us a complete and accurate delivery address.

8. Returns, Refunds, and Cancellations

• You may cancel an order for a full refund at any time before it ships.
• After shipment, our Shipping & Returns policy applies.
• For safety reasons, ammunition sales are final once shipped, except for damaged, defective, or incorrectly shipped products, or where the law gives you other rights.
• Optics and other non-ammunition products follow the separate return terms in that policy.

9. Safe Handling and Use

• Follow your firearm manufacturer's instructions, all applicable laws, and standard firearm-safety practices.
• Use only ammunition of the correct caliber and type for your firearm.
• Always wear eye and ear protection when shooting.
• Store ammunition securely, away from children and unauthorized persons, and away from heat and open flame.
• To the extent the law allows, we are not responsible for injury or damage caused by misuse, reloading or modification, use in an unsuitable or defective firearm, improper storage, or failure to follow instructions or the law. This does not waive any rights that cannot be excluded by law.

10. Warranties

• Some products may carry a manufacturer's warranty.
• Except for any express warranty we provide or rights required by law, our products and the Site are provided “as is.”
• To the extent the law allows, we disclaim all other warranties, including implied warranties of merchantability and fitness for a particular purpose. Some jurisdictions do not allow these exclusions, so they may not apply to you.

11. Limitation of Liability

• To the extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim related to a purchase is limited to the amount you paid for the product involved.
• These limits do not apply where the law does not allow liability to be limited or excluded.

12. Indemnification

To the extent the law allows, you agree to indemnify and hold harmless Terminal Pursuit Ammo and its owners, employees, and agents from third-party claims, losses, and reasonable expenses arising from your unlawful conduct, your material breach of these Terms, or your misuse of our products. You are not required to indemnify us for our own unlawful conduct or for liability that cannot lawfully be transferred.

13. Accounts and Website Use

• Keep your account login details confidential and tell us promptly about any unauthorized use.
• Do not use the Site for any unlawful purpose, interfere with its operation, or try to access systems or information without authorization.
• All content on the Site, including text, images, logos, and product designs, belongs to Terminal Pursuit or its licensors and may not be reused without our permission, except as the law allows.

14. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. Subject to any mandatory rights or jurisdiction rules that apply to you, disputes will be heard in the state or federal courts serving Christian County, Missouri.

15. Changes to These Terms

We may update these Terms from time to time. The version in effect when you place an order governs that order. The “Last updated” date at the top of this page shows when the Terms were last revised.
